Participation
1. Welcome to the Polaroid Flip Tour. We’re glad that you would like to participate!
2. The Flip Tour is organized by Polaroid International B.V., with registered address at Danzigerkade 16 C, 1013 AP, Amsterdam, Netherlands (Polaroid). Polaroid can be contacted via info@polaroid.com, or via the Support page on www.polaroid.com.
3. These terms and conditions are applicable if you participate in the Polaroid Flip Tour with a ticket, or if you have purchased a ticket for the tour. By purchasing a ticket or by participating in the Polaroid Flip Tour you accept these terms and conditions.
4. The Flip tour is only open to people who have reached the age of 16, provided that people under the age of 18 are accompanied by an adult who also buys a ticket.
Ticket
5. A ticket for the Polaroid Flip Tour can only be purchased via Eventbrite.
6. You will only be granted access to the Polaroid Flip Tour by showing a valid and undamaged ticket. If you want to enter the Polaroid Flip Tour, you might be asked to show proof of identity for age checks (if needed).
7. Your ticket gives you the right to participate in the Polaroid Flip Tour. Access is only given to the first holder of the ticket scanned at the entrance. You must take responsibility for ensuring that you remain the (sole) holder of the ticket issued by Polaroid via Eventbrite.
8. Polaroid reserves the right to set a maximum on the number of tickets to be ordered by a participant. In that case the participant is obliged to comply with such maximum number.
9. You may not resell your ticket(s) for the Polaroid Flip Tour in the context of commercial purposes.
10. You cannot return your ticket(s), because an exception of the right of withdrawal applies on the ground of section 6:230p under the Dutch Civil Code. No show is also no refund.
Program
11. Polaroid will aim for the Polaroid Flip Tour to be carried out in accordance with what has been announced as far as possible. Polaroid is however not liable for deviations from the program, including for the length of the tour. The starting date mentioned on the ticket is subject to change.
Use of Polaroid Products and License
12. During the Polaroid Flip Tour, you get the opportunity to use the Polaroid Flip Camera. This Polaroid Flip Camera will be loaned to you by Polaroid, provided that you sign a loan agreement at the beginning of the Polaroid Flip Tour.
13. You will be responsible for any loss, theft or damage to the loaned Polaroid Flip Camera. You agree to indemnify, and hold Polaroid harmless for loss, theft and damage to the loaned Polaroid Flip Camera. The value (RRP €219.99) of any lost or damaged camera will be charged to you after the tour based on repair or replacement cost.
14. All participants will receive 1 pack of Polaroid i-Type Film with 8 pictures. You hereby grant to Polaroid the non-exclusive, perpetual, irrevocable, royalty-free, worldwide right to commercially use the Polaroid pictures taken by you during the Polaroid Flip Tour (together with your name to credit you) on Polaroid’s and its retailers online channels (such as website, social media, app and e-newsletter) in the context of the Polaroid Flip Tour. You will retain the ownership (meaning that you can keep the 8 Polaroid pictures) and any possible intellectual property rights to your Polaroid pictures. You indemnify and hold Polaroid harmless against all claims of third parties arising out of or in connection with the use of your Polaroid pictures in line with this license.
Image and video recording
15. Polaroid is for commercial purposes authorized to make or arrange for image and/or video recordings to be made of and during the Polaroid Flip Tour and of the participants and to reproduce and/or publicize or arrange for the publication of these recordings in any form and in any manner, including but not limited to publish and/or use of these recordings on Polaroid’s and its retailers online channels (such as website, social media, app and e-newsletter), and for press use/coverage. By obtaining a ticket to the Polaroid Flip Tour and/or by participating in the Polaroid Flip Tour, you unconditionally consents to the aforementioned recordings being made and to the processing, publication and use thereof, without Polaroid, its affiliated companies or any of its retailers being liable to pay any compensation to you at any time.
16. You hereby irrevocably renounce any interest that you may have in the recordings of the Polaroid Flip Tour. Insofar as you have any copyright, neighboring rights and/or portrait rights to the recordings, you hereby unreservedly assign these rights to Polaroid and hereby irrevocably renounces your personality rights and/or confirm you will not invoke these rights. In the event this transfer is not legally valid in advance, you are obliged at first request of Polaroid to give written notice of this permission and/or sign a deed of transfer to transfer these rights free of charge to Polaroid.
Cancelling of the tour
17. In case of force majeure in the broadest sense, which in this regard also includes strikes, terrorist threat, decision to cancel by the competent authority, fire, bad weather conditions, pandemic, etc., Polaroid will be entitled to move the Polaroid Flip Tour to another date or location or to cancel the Polaroid Flip Tour, upon Polaroid’s discretion.
18. Polaroid will not be responsible for damage arising from moving or cancelling the Polaroid Flip Tour. If the Polaroid Flip tour is moved or cancelled by Polaroid this will be communicated to the people who purchased a ticket via Eventbrite, via their provided email address. This communication will include the applicable terms for a refund. The refund will be made within a reasonable period after the date of the cancelled tour. The refund will not include the service fees paid to Eventbrite.
19. If the Polaroid Flip Tour is rescheduled by Polaroid due to force majeure, the ticket will remain valid for the new date that the Polaroid Flip Tour is moved to. If you are not able to attend the Polaroid Flip Tour on the new date, you are entitled to submit your ticket at Eventbrite against refund of the amount of the ticket (excluding service fees) that you have paid via Eventbrite.
Liability
20. Your participation in the Polaroid Flip Tour and visit of the Polaroid Flip Tour venue is at your own risk. Polaroid cannot be held liable for any damage which you suffer in this regard. Polaroid accepts no liability for any bodily injury and/or damage or theft of goods.
21. Polaroid is solely liable for damage to participants resulting for a shortcoming attributable to Polaroid. The total liability of Polaroid is always limited to the compensation for the reasonable, demonstrable, and direct out-of-pocket damage and cost of a participant. Liability of Polaroid for indirect damage, including consequential loss, intangible damage, loss of profits and/or lost savings is excluded.
22. You are obliged to report any damage to Polaroid within 48 hours of the Polaroid Flip Tour via the email address as referred to in paragraph 2 above.
Offers made at the tour
23. You may be offered products at the Polaroid Flip Tour by third parties. Although Polaroid chooses these third parties with care, it is not a party to any agreement between you and the third party. Polaroid will not be liable under any circumstances for any damage arising from the purchase of a product by you. You indemnify Polaroid against any claim for costs or damage that may arise from an agreement between you and the third party. Any applicable general terms and conditions of the third party may be requested from this third party.
Personal data
24. Your personal details will solely be processed in the context of Polaroid Flip Tour to allow us to manage your booking, communicate essential tour information, to credit you in relation to your Polaroid pictures taken during the tour, and to improve our services. We also refer to Polaroid’s, and Eventbrite’s privacy policies for more information of how we handle your personal data.
Other Terms
25. You are at all times obliged to comply with the law, regulations, and any instructions of Polaroid during the Polaroid Flip Tour. Insofar you do not comply, do not comply fully and/or do not comply on time with the law, regulations, and any instructions, Polaroid may, depending on the specific circumstances, suspend its obligations, terminate the agreement without being liable to pay any compensation, and remove you from the Polaroid Flip Tour.
26. Polaroid is at all times entitled to amend or complement these terms and conditions. The amended version will in that case be published on the Eventbrite Polaroid Flip Tour page. If the amendment or addition significantly affects the rights or obligations of the participants, Polaroid will notify the participants.
27. These terms and conditions shall be governed by Dutch law.
